John Hemmer & the Showgirls is a 35-minute documentary chronicling the American nightclub era of the mid-20th century as told through retired singer, John Hemmer’s personal and professional experiences. This award-winning film enjoyed its world premiere at Rhode Island International Film Festival in 2017 where it was honored with First Prize for Alternative Spirit in Documentary Award among other accolades.

    Public Performance Rights

    Please read the below Licensing Agreement carefully, and mark a check next to ALL licensing terms to indicate your understanding of each.

    agreement
    This Licensing Agreement (the "Agreement") between documentary short (the "Licensor"), and the organization ("the Licensee") indicated in this Screening Application ("the Application"), is made to grant the Licensee the limited license to publicly exhibit the documentary short JOHN HEMMER & THE SHOWGIRLS ("the Film") only on the date(s) and at the venue(s) specifically indicated in the Application, in accordance with the following terms and conditions. The Licensee agrees to these terms and conditions by checking and signing below and accepting delivery of the film on DVD, Blu-Ray, or any other medium from Licensor.
    rights and payment
    Licensor hereby grants to Licensee the non-exclusive, and revocable license to exhibit the Film in a public exhibition to be directly sponsored, co-sponsored, hosted, or presented under the auspices of the Licensee named herein. The Total Fee ("Fee") indicated in the Application shall become due upon completion of this form. If the Film arrives in unplayable condition, Licensee may request a new copy be sent, so long as this request is made within 7 days of the date unplayable copy is first delivered. In such a case, Licensor has the option to cancel the contract with 7 days of the date the request is made and return all money paid, or resend within 7 days of such request.
    definition of public exhibition
    The public exhibition of the Film shall be defined as any display, performance, viewing, screening, or playback of the Film occurring at a place open to the public or at any space where a substantial number of persons outside of a normal circle of a family and its social acquaintances is gathered. Public exhibition does not apply to any broadcast, cable, or satellite transmission of the film, nor any exhibition of the film in which all viewers and playback equipment are not in the same room or venue. Licensor acknowledges that the Film may be exhibited before an audience to which an admission fee is being charged.
    reservation of rights
    Legal title to the Film shall at all times remain with the Licensor, and all rights therein are reserved to Licensor. The term "payment" or "fee" as used herein means specifically payment only for the right and license for the Licensee to use the Film, but without any change in ownership or title and otherwise subject to the terms and conditions of this Agreement.
    sublicense
    With the exception of public and university libraries lending programs to their authorized cardholders, and schools lending programs to students and their families, the Licensee shall not sublicense, sublease, rent, sell, transfer, loan, or otherwise part with the possession of the Film, in any format secured by the Licensee, to any third parties, including family members, colleagues, or associated organizations, schools, or businesses. Public exhibition rights are not transferable to any third party not indicated in the Application
    alterations
    Licensee is not bound to exhibit the Film in its entirety and may exhibit portions or excerpts of the Film as needed, but shall not duplicate, "burn", cut, edit, alter, digitize, compress, or "rip" the Film or otherwise tamper therewith. In no event shall the Film be exhibited without complete attribution to Licensor.
    refunds
    In the event that Licensee must cancel a public exhibition, Licensee may cancel this Agreement, and is entitled to a full refund of the licensing fee indicated below, less all original shipping, handling and customs fees, provided that the refund is requested within 7 days of receipt of the Film. Cancellation and refund requests made more than 7 days after receipt of the Film cannot be honored. Refunds will be processed within 2 business days after receipt of the returned screening formats, which must be in the original condition in which they were received.
    returns
    Unless otherwise explicitly agreed upon in writing (email shall suffice for this purpose) by Licensee and Licensor prior to the date of first exhibition indicated in the Application, all formats (including but not limited to DVD, Blu-Ray or digital file) must be returned to Licensor within 7 days of the final licensed exhibition of the film. Returns should be made to KirstenStudio, LLC PO Box 302, New York, NY 10024 USA unless otherwise indicated.
    disclaimer of warranty
    LICENSOR MAKES NO WARRANTIES EXPRESS OR IMPLIED WHATSOEVER, AND ALL IMPLIED WARRANTIES INCLUDING THE WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE HEREBY DISCLAIMED. Licensor shall have no other obligations, and licensee shall have no other recourse other than that specifically stated in this Agreement.
    complete agreement
    This Agreement sets forth the entire and complete agreement and understanding between the parties and supersedes all prior agreements or understandings, written or unwritten.
